This website includes publicly-accessible content, as well as ability to purchase from the Australian Republic Movement online shop and become a member of the Australian Republic Movement.  These Website Terms of Use apply to this website generally.  The Online Shop and Membership Terms & Conditions below apply to purchases: (i) made via the Australian Republic Movement’s online shop; and (ii) memberships to the Australian Republic Movement. Online Shop and Membership Terms & Conditions

Placing an order

When you place an order for merchandise or become a member of the Australian Republic Movement, you should receive an acknowledgement e-mail confirming receipt of your order or membership.

We only accept your order or membership once payment has been approved and we have debited the payment card (and then the contract is made based on these terms).

Prices for the Online Shop

Prices include GST (where applicable).

Delivery costs will be shown on the check out screen when placing your order.

For overseas purchasers, the issuer of your credit or debit card may charge currency conversion or other fees in relation to your order. You should check with the issuer of your credit or debit card for details of any such fees.

Delivery for merchandise ordered via the Online Shop

Delivery may be subject to delays caused by postal/carrier delays, logistics or bad weather. Delivery times stated on the website are estimates.

Returns

We will replace or reprint an item if it has been delivered with defects or incorrectly (wrong design, style/colour/sizes). On receipt of a photo of the item received, we will reprint and send out a replacement at no charge. You don’t need to send back the incorrect goods.

Change of mind returns are determined on a case-by-case basis. These include the customer preferring another size or the customer ordering the wrong colour or design. Please contact info@republic.org.au for more information.

Membership of the Australian Republic Movement

Any person who agrees with the objectives of the Australian Republic Movement and agrees to promote them may become a member by application to the ARM and payment of the membership fee specified from time to time by the National Committee.

Individuals can become a member of the Australian Republic Movement by completing the membership joining process at www.republic.org.au/join

Multiple membership tiers are available and all confer the same voting rights and opportunities to participate in the Movement.

Subject to any specific restrictions on any category of membership stipulated by the National Committee, Members are entitled to:

·        be nominated for election to the National Committee

·        nominate candidates for the National Committee

·        vote in elections for nationally elected members of the National Committee

·        if they are between 16 and 25 years of age inclusive, vote for members representing the Youth Wing at national and Branch level

·        vote for members of the Branch Councils in the jurisdiction in which they reside

·        elect Forum office bearers in the jurisdiction in which they reside

·        participate in the Branches and Forums of which they are a member

·        if they are between 16 and 25 years of age inclusive, participate in the Youth Wing

·        participate generally in the activities of the ARM

·        receive information from the ARM as the ARM makes available.

Members who are less than 16 years old enjoy all the rights of membership stipulated by the National Committee.

The ARM will keep and maintain a Register of Members. The Register of Members will include the Member's full name, address, the date on which the entry of the member's name in the Register is made, date of last payment of membership fee and category of membership.

The National Committee may from time to time specify different membership categories and membership fees and entry requirements for those categories. The categories of membership are: (a) Ordinary Members (Gold, Silver, Standard and Concession) – these members pay an annual membership fee; (b) Life Members – these members pay a once only membership fee and receive membership for the life of the ARM; and (c) Honorary Members - the National Committee may grant honorary membership to a person as it sees fit and without payment of any membership fee.

Members whose membership fee or any other amount payable to the ARM is more than one month in arrears: (a) will not be entitled to vote at any General Meeting or in any election of Members of the National Committee or be eligible to be elected, or nominate a Member for election, to the National Committee and will lose all other membership privileges; and (b) in the discretion of the Executive, have their membership terminated.

Termination of membership does not entitle a person to any refund of all or part of any membership fee, unless the ARM determines otherwise.

 

Disclaimer of Liability

All express or implied guarantees, warranties, representations, or other terms and conditions relating to these Online Shop and Membership Terms & Conditions or their subject matter, not contained in these Online Shop and Membership Terms & Conditions, are excluded from these Online Shop and Membership Terms & Conditions to the maximum extent permitted by law.

Nothing in these Online Shop and Membership Terms & Conditions excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by any legislation which cannot lawfully be excluded or limited. This may include the Australian Consumer Law which contains guarantees that protect the purchasers of goods and services in certain circumstances.

If any guarantee, warranty, term or condition is implied or imposed in relation to these Purchase Terms & Conditions under the Australian Consumer Law or any other applicable legislation and cannot be excluded (a “Non-Excludable Provision”), and we are lawfully able to limit the remedy for a breach of the Non-Excludable Provision, then our liability for breach of the Non-Excludable Provision is limited to one or more of the following at our option:

(a) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or

(b) in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again.

Without limiting your rights and remedies pursuant to any Non-Excludable Provisions, and to the maximum extent permitted by law, we are not liable for, and no measure of damages will, under any circumstances, include:

(a) special, indirect, consequential, incidental or punitive damages; or

(b) damages for loss of profits, revenue, goodwill, anticipated savings or loss or corruption of data, whether in contract, tort (including negligence), in equity, under statute, under an indemnity, based on fundamental breach or breach of a fundamental term or on any other basis, whether or not such loss or damage was foreseeable and even if advised of the possibility of the loss or damage.
